CAR RENTAL REGULATIONS

GENERAL PROVISIONS

1. These Car Rental Regulations (hereinafter referred to as the Regulations) specify in detail the terms and conditions of car rental agreements without a driver concluded by Fides sp. z o.o. with its registered office in Gola Grodkowska 5, 49-200 Grodków, NIP: 747 191 48 90.

2. The Regulations apply to all contracts of the above-mentioned Rental Agreements, unless the Agreement provides otherwise.

3. These Regulations, the Handover Protocol and the Vehicle Acceptance Protocol as well as the Price List constitute an integral part of the Rental Agreement.

4. In the event of a conflict between the Agreement and the Regulations, the parties are bound by the Agreement.

5. Pages:

a. the lessor (Fides sp. z o.o. with its registered office in Gola Grodkowska 5, 49-200 Grodków, NIP: 747 191 48 90);

b. lessee (customer): a natural or legal person;

c. a person authorized to drive a vehicle (driver).

6. The Lessee of the vehicle and the Person authorized to drive may be:

a. a natural person with Polish citizenship, permanent residence, holding a driving license recognized in the territory of the Republic of Poland and meeting the condition of having a driving license for a minimum period of 12 months preceding the date of conclusion of the rental agreement;

b. a natural person who does not have Polish citizenship, has a valid passport, has a driving license recognized in the territory of the Republic of Poland and meets the condition of having a driving license for a minimum period of 12 months preceding the date of concluding the rental agreement;

c. a legal person represented by a natural person meeting the criteria listed in point 6a or 6b.

7. The requirements set out in this point apply throughout the duration of the rental agreement. If it is found that the Lessee or the Person authorized to drive the vehicle fails to meet the requirements indicated in the preceding point, the Lessor is entitled to immediately withdraw from the rental contract and pursue any claims for damages in this respect.

8. The rented vehicle may not be sublet or transferred to another person for use without the written consent of the Lessor.

9. The car may only be driven by the Lessee or persons indicated in the contract as Users. The obligation to report Users lies with the Lessee. Users should be reported no later than the date of signing the contract.

10. The Lessee takes full responsibility for the rented vehicle until it is brought back by the Lessor when returning the vehicle on the basis of the handover protocol. The person authorized to drive the vehicle is responsible for the vehicle in the same way as the Lessee.

OBLIGATIONS OF THE LESSEE AND RULES OF USE OF THE VEHICLE

11. During the use of the vehicle, the Lessee is obliged to:

a. not exceeding the monthly mileage limit of the rented vehicle in the amount of 2,500 km, unless the Agreement provides otherwise;

b. carry valid documents required by road traffic control;

c. securing the car against theft (locking the car every time and turning on all anti-theft devices, careful protection of documents and keys outside the vehicle);

d. performing daily maintenance of the vehicle (checking and replenishing engine oil, coolant, brake fluid, washer fluid, checking tire pressure and tire condition, operation of signal, dipped and road lights);

e. incur during the term of the contract the purchase costs listed in point d) of liquids as part of the daily operation of the vehicle;

f. use the type of fuel in the vehicle in accordance with the engine specification specified in the registration certificate and in the technical documentation of the vehicle;

g. incur the costs of fuel purchase during the term of the contract. Any doubts as to the fuel level immediately after handing over the vehicle should be reported by the Lessee within 5 km from the start of the ride, otherwise the complaints will not be considered.

h. keep the vehicle clean and deliver it clean after the end of the contract.

12. Moving the rented vehicle beyond the border of the Republic of Poland is possible only after the prior written consent of the Lessor, taking into account additional costs in accordance with the Price List. In the event of an unauthorized departure, the Lessee shall bear all costs related to the failure, damage to the vehicle or received penalties (due to the lack of appropriate documents, equipment or authorizations) in the territory of another country. The Lessee will also bear the cost of transporting the vehicle to the Lessor’s headquarters in Poland. The Lessee’s willingness to travel outside of Poland should be reported at least 24 hours before the planned departure to the following e-mail address: rental@fides-logistics.com. Departure will be possible after receiving a written consent from the Lessor and specifying the conditions.

13. The Lessee is forbidden to expose the vehicle to any damage and to use it contrary to its intended use, in particular:

a. towing other vehicles, trailers or other items with the rented vehicle;

b. exceeding the permissible load capacity;

c. smoking in the vehicle;

d. make modifications or other changes to the rented vehicle that are contrary to its properties and intended use
